Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and ChartingLens LLC ("ChartingLens", "we", "us"). They apply to the ChartingLens website at chartinglens.com and the ChartingLens apps for iPhone, iPad and Android (together, the "Service"). The same Terms apply on the website and in both apps. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older and able to enter into this agreement.

3. The Service

ChartingLens provides charting, market data, technical analysis tools, alerts, a stock screener, educational content and AI features for informational and educational purposes. The Service shows information about stocks, cryptocurrencies, forex and other markets, and publicly available filings such as institutional holdings. ChartingLens does not execute trades, hold funds or provide brokerage services.

4. Not Financial Advice

Everything in the Service, including charts, indicators, signals, screener results, alerts, educational content and AI responses, is for informational and educational purposes only. It is not financial, investment, tax or legal advice, and it is not a recommendation to buy, sell or hold any security or other asset. You are solely responsible for your own investment and trading decisions. You should:

• Do your own research before making any investment decision
• Consider consulting a qualified, licensed financial adviser
• Understand that past performance, including historical signal results and backtests, does not guarantee future results
• Accept that every investment carries risk, including the risk of losing all of your money

5. AI Features

ChartingLens uses artificial intelligence to answer questions, analyze charts, build and edit indicators, and generate signals and other content. To produce a response, the content you send is processed by third-party AI services as described in our Privacy Policy. AI-generated content:

• Can be wrong, incomplete or out of date, even when it sounds confident
• Is not a recommendation to buy, sell or hold any security
• Should never be the only basis for an investment decision

Check AI output before relying on it. Do not enter personal or sensitive information into AI features, and do not use them to create unlawful, harmful or abusive content. You can report a wrong or offensive response with the thumbs down button.

6. Market Data

Market data, filings and other information in the Service come from third-party sources. Data may be delayed, incomplete or inaccurate, filings such as 13F reports are published with a delay, and data processing can introduce errors. We make no guarantee that any data is complete, accurate or timely. Market data is provided for your personal use only and may not be redistributed or resold.

7. Your Account

• Give accurate information when you create your account and keep it up to date
• Keep your sign-in details secure; you are responsible for activity on your account
• Tell us right away at support@chartinglens.com if you think your account has been used without permission

You can delete your account at any time under Profile → Account → Delete Account, as described in our Privacy Policy and on our account deletion page.

8. Your Content

You own the content you create in the Service, such as watchlists, notes, drawings, alerts, layouts and the scripts you write or paste. You give us permission to store, copy and process that content only as needed to provide the Service to you, for example to sync it across your devices, run your alerts and scans, and send it to AI services when you use AI features. We do not publish your content or use it for any other purpose. You are responsible for having the right to use any content or script you upload.

9. Acceptable Use

You agree not to:

• Use the Service for anything unlawful, or to violate anyone else's rights
• Copy, scrape, harvest, redistribute or resell data or content from the Service, including through automated tools
• Reverse engineer, decompile or try to get around any security, usage limit or paid feature
• Share your account or sell access to it
• Interfere with or overload the Service, or try to access other users' accounts or data
• Upload malicious code, or content that is unlawful, harmful or infringing

10. Subscriptions and Billing

Some features require a paid plan. Paid plans are subscriptions that renew automatically at the end of each billing period (monthly or yearly) until you cancel. The price, billing period and what each plan includes are shown before you buy.

• Bought on chartinglens.com: billed by Stripe. Cancel anytime in Profile → Account → Manage Billing. Your plan stays active until the end of the period you paid for.
• Bought in the iOS app: billed to your Apple ID. Payment is charged at confirmation of purchase, and the subscription renews unless canceled at least 24 hours before the end of the current period. Manage or cancel in Settings → Apple ID → Subscriptions. Refunds are handled by Apple.
• Bought in the Android app: billed through Google Play. Cancel anytime in Google Play → Payments & subscriptions → Subscriptions; cancellation takes effect at the end of the current period. Refunds are handled under Google Play's refund policy.

Deleting your ChartingLens account cancels a subscription bought on our website, but does not cancel an App Store or Google Play subscription; cancel those with Apple or Google. For website purchases, refunds are handled case by case; contact support@chartinglens.com. We may change prices or plan features with reasonable notice; a price change applies from your next renewal, and you can cancel before it takes effect.

11. Changes to the Service

We are always improving ChartingLens, so features may be added, changed or removed. We may also suspend or discontinue the Service. If we discontinue a paid plan, we will give you reasonable notice.

12. Suspension and Termination

You can stop using the Service and delete your account at any time. We may suspend or close your account if you violate these Terms, misuse the Service, or act fraudulently or abusively. Sections 4, 5, 6 and 13 through 17 continue to apply after your account is closed.

13. Intellectual Property

The Service, including its software, design, text, graphics and logos, is owned by ChartingLens LLC and protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable license to use the Service under these Terms. You may not copy, modify or distribute any part of the Service without our permission.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted, error free or secure, or that any data, signal or AI response is accurate.

15. Limitation of Liability

To the fullest extent permitted by law, ChartingLens LLC and its owners and operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, trading losses, investment losses or lost data, arising from or related to:

• Your use of, or inability to use, the Service
• Any investment or trading decision you make, including one based on information, signals or AI responses from the Service
• Delays, interruptions or inaccuracies in the Service or its data
• Unauthorized access to your account

Our total liability for any claim related to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US$100. Some places do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to defend and indemnify ChartingLens LLC against any claims, losses and expenses, including reasonable legal fees, that arise from your misuse of the Service or your violation of these Terms or of anyone else's rights.

17. App Store and Google Play

If you downloaded ChartingLens from Apple's App Store or Google Play, these Terms are between you and ChartingLens LLC only, not Apple or Google, and ChartingLens LLC, not Apple or Google, is responsible for the app and its content. Apple and Google have no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation for the app other than refunding the purchase price if the app fails to meet an applicable warranty, which you can request from Apple. ChartingLens LLC, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the app infringes someone else's intellectual property. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. You must also follow the store's own terms of service when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. Changes to These Terms

We may update these Terms. We will change the date at the top, and if a change is significant we will tell you in the Service or by email before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of the United States and of the state in which ChartingLens LLC is organized, without regard to conflict of law rules. Nothing in these Terms limits any rights you have under the consumer protection laws of the place where you live.
